A common misconception is that to have Indigenous heritage considered in the criminal justice system, you must have “status”. The Supreme Court of Canada has made it clear that this is not the case. The effects of Colonialism are far-reaching and have effects through many generations.
Indigenous heritage does not represent a “get out of jail free” card, but it does bear special consideration and treatment in the criminal justice system, from the bail stage right through sentencing. We have extensive experience navigating the Gladue principles, and were involved in the very first Indigenous Sentencing Circle to be held in Waterloo Region (hopefully the first of many).
